EVENT WAIVER & RELEASE

The California Association of REALTORS® is committed to supporting a safe, professional, and orderly event. As part of the registration process, all attendees and exhibitors will be asked to review and acknowledge the Waiver and Release of Claims below.

You are registering to attend and participate in the REimagine!® Conference & Expo (“Event”) hosted by the California Association of REALTORS® (“C.A.R”).In consideration of being permitted to register for, attend, and participate in the Event, and in recognition of C.A.R.’s reliance hereon, you agree to the terms and conditions set forth in this Waiver and Release of Claims (“Release”).

 

You acknowledge that attendance and participation in the Event includes risks, including, without limitation, injury (including death), property damage, and exposure to contagious or communicable diseases. You understand that although C.A.R. has implemented measures intended to reduce risks associated with the Event, C.A.R. cannot guarantee that you will not be injured or exposed to, or infected with, a communicable disease by attending or participating in the Event.

ASSUMPTION OF RISK
 

YOU UNDERSTAND THAT ATTENDING AND PARTICIPATING IN THE EVENT MAY INVOLVE KNOWN AND UNKNOWN RISKS, INCLUDING WITHOUT LIMITATION, INJURY, ILLNESS, DISABILITY, DEATH, PROPERTY DAMAGE, EXPOSURE TO COMMUNICABLE DISEASE, AND ECONOMIC LOSS. YOU VOLUNTARILY CHOOSE TO ATTEND AND PARTICIPATE IN THE EVENT AND KNOWINGLY ASSUME ALL RISKS ARISING OUT OF OR RELATED TO YOUR ATTENDANCE OR PARTICIPATION, INCLUDING RISKS CAUSED, IN WHOLE OR IN PART, BY THE NEGLIGENCE OF C.A.R. OR ANY RELEASEE, TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW.

RELEASE AND WAIVER
 

YOU KNOWINGLY AND VOLUNTARILY RELEASE, WAIVE, AND DISCHARGE C.A.R. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, “RELEASEES”) FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES, WHETHER KNOWN OR UNKNOWN, ARISING OUT OF OR RELATED TO YOUR REGISTRATION FOR, ATTENDANCE AT, OR PARTICIPATION IN THE EVENT, INCLUDING CLAIMS ARISING FROM INJURY, ILLNESS, DISABILITY, DEATH, PROPERTY DAMAGE, ECONOMIC LOSS, OR OUT-OF-POCKET EXPENSES, EVEN IF CAUSED, IN WHOLE OR IN PART, BY THE NEGLIGENCE OF C.A.R. OR ANY RELEASEE, TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW. YOU AGREE NOT TO BRING OR ASSERT ANY SUCH CLAIM AGAINST C.A.R. OR ANY RELEASEE.

 

MEDICAL ACKNOWLEDGEMENT AND RELEASE
 

YOU CONFIRM AND AGREE THAT YOU WILL NOT ATTEND THE EVENT IF YOU HAVE A CONFIRMED OR SUSPECTED COMMUNICABLE DISEASE AND HAVE BEEN ADVISED BY A HEALTHCARE PROVIDER TO AVOID CONTACT WITH OTHERS. YOU ALSO AGREE TO COMPLY WITH ALL APPLICABLE FEDERAL, STATE, AND LOCAL LAWS, ORDERS, GUIDELINES, AND DIRECTIVES, AND WITH ALL EVENT SAFETY PROTOCOLS ESTABLISHED BY C.A.R.

YOU CONSENT TO RECEIVE MEDICAL TREATMENT, INCLUDING EMERGENCY MEDICAL TREATMENT, THAT MEDICAL PERSONNEL OR EMERGENCY RESPONDERS DEEM NECESSARY IN CONNECTION WITH YOUR ATTENDANCE AT OR PARTICIPATION IN THE EVENT. YOU UNDERSTAND AND AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR ALL COSTS RELATED TO SUCH TREATMENT AND ANY RELATED MEDICAL TRANSPORTATION OR EVACUATION. YOU RELEASE AND HOLD HARMLESS C.A.R. AND THE RELEASEES FROM ANY CLAIM ARISING OUT OF OR RELATED TO SUCH TREATMENT, TRANSPORTATION, OR EVACUATION, TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW.

 

INDEMNIFICATION
 

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS C.A.R. AND THE RELEASEES FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, ACTIONS, LOSSES, DAMAGES, LIABILITIES, COSTS, AND EXPENSES, INCLUDING REASONABLE ATTORNEYS’ FEES, ARISING OUT OF OR RELATED TO YOUR REGISTRATION FOR, ATTENDANCE AT, OR PARTICIPATION IN THE EVENT, YOUR ACTS OR OMISSIONS, YOUR VIOLATION OF ANY LAW OR EVENT RULE, OR YOUR BREACH OF THIS RELEASE, EXCEPT TO THE EXTENT SUCH CLAIMS ARE CAUSED BY THE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF C.A.R. OR A RELEASEE.

 

This Release constitutes the entire agreement between you and C.A.R. regarding the subject matter of this Release and supersedes any prior or contemporaneous understandings, agreements, representations, or warranties, whether written or oral, regarding that subject matter. If any provision of this Release is held invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. This Release is binding on you and your heirs, executors, administrators, successors, and assigns, and inures to the benefit of C.A.R. and the Releasees. This Release will be governed by California law. To the extent permitted by law, any claim arising out of or related to this Release or the Event shall be brought only in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts.

 

By registering for, attending, entering, or participating in the Event, you acknowledge and agree that you have read, understand, and are bound by this Waiver and Release of Claims, including its release of liability and waiver of certain legal rights.
